Rule 69
Collective Bargaining Procedures and Agreements
:(1) If a claim is received in accordance with Rule 68, the employer's association shall discuss with the group collective bargaining committee and generally resolve the dispute related to such claim within twenty one days of submission of the claim. If there is an agreement between the employers' association and such collective bargaining committee, the period to settle the dispute can be extended.
(2) If the dispute is not resolved according to sub-rule (1), the group collective bargaining committee may submit an application to the department.
(3) If an application is received according to sub-rule (2), the department shall notify the relevant employers' association and the collective bargaining committee of the date and time for discussion.
(4) The department shall, within thirty days of receipt of the application in accordance with sub-rule (2), negotiate between the relevant employers' association and collective bargaining committee and resolve the dispute related to the claim.
(5) Notwithstanding anything contained in sub-rule (4), the period for resolving the dispute may be extended on the basis of the agreement of all the three parties.
(6) If there is a reconciliation between the relevant employers' association and the collective bargaining committee during negotiations as per sub-rule (5), the dispute related to the claim shall be considered resolved.
(7) The reconciliation made in accordance with sub-rule (6) shall be binding on the parties concerned.
(8) If the dispute cannot be resolved by following the procedure of dispute resolution according to this rule, the related parties may follow the procedure according to Chapter-19 of the Act.
